Sobre este tema nos han consultado sobre la inamovilidad laboral en caso de embarazo o hijos menores de un año, se debe tener muy en cuenta la siguiente normativa
Decreto Supremo Nº 12, 19 de febrero de 2009.pdf
Artículo 1°.- (Objeto) El presente Decreto Supremo tiene por objeto reglamentar las condiciones de inamovilidad laboral de la madre y padre progenitores que trabajen en el sector público o privado.
Artículo 2°.- (Inamovilidad laboral) La madre y/o padre progenitores, sea cual fuere su estado civil, gozarán de inamovilidad laboral desde la gestación hasta que su hijo o hija cumpla un (1) año de edad, no pudiendo ser despedidos, afectarse su nivel salarial ni su ubicación en su puesto de trabajo.
Artículo 3°.- (Requisitos) A los efectos de beneficiarse de la inamovilidad laboral establecida en el presente Decreto Supremo, la madre y/o padre progenitores deberán presentar los siguientes documentos:
- a) Certificado médico de embarazo extendido por el Ente Gestor de Salud o por los establecimientos públicos de salud.
- b) Certificado de matrimonio o Acta de reconocimiento ad vientre extendido por el Oficial del Registro Civil.
- c) Certificado de Nacimiento del hijo o hija extendido por el Oficial del Registro Civil.
Artículo 4°.- (Fraude) Quienes incurran en la falsificación o alteración de los documentos requeridos en el Artículo 3 del presente Decreto Supremo, serán pasibles a las sanciones establecidas en la normativa vigente.
Artículo 5°.- (Vigencia del beneficio)
- No gozarán del beneficio de inamovilidad laboral la madre y/o padre progenitores que incurran en causales de conclusión de la relación laboral atribuible a su persona, previo cumplimiento por parte del empleador público o privado de los procedimientos que fijan las normas para extinguir la relación laboral.
- La inamovilidad laboral no se aplicará en contratos de trabajo que por su naturaleza sean temporales, eventuales o en contratos de obra; salvo las relaciones laborales en las que bajo éstas u otras modalidades se intente eludir el alcance de esta norma. En este último caso corresponderá el beneficio.
III. La inamovilidad laboral del padre y/o madre progenitores se mantendrá siempre y cuando cumplan con sus obligaciones legales y de asistencia para con el hijo o hija.
Artículo 6°.- (Incumplimiento) Si el empleador no cumple con el presente Decreto Supremo, el Ministerio de Trabajo, Empleo y Previsión Social, previa verificación, dispondrá la reincorporación de la madre y/o padre progenitores, con goce de haberes y otros derechos sociales por el tiempo que duró la suspensión de la relación laboral, sin perjuicio de las sanciones que correspondan por infracciones a leyes sociales, salvando los derechos de la madre y/o padre progenitores en la vía judicial correspondiente.

I’m now an art director who still loves writing headlines, dialogue and radio as well doing all the other arty stuff. I’m not extroverted in a ‘look at my cock’ sort of way and I don’t wear specs or bang on about the book I want to write. Therefore, I don’t believe in your stereotyping of creative personalities. However, where stereotyping do exsist, is that copywriters are generally acknowledged as the ones who come up with the ideas. I for one think it’s a shame but that’s just coming from an art director who loves doing everything.

No doubt, they declared her “fair game” or whatever they call it now and some enterprising member decided this would be a fun way to get back at her
